Is there a reasonable expectation of privacy? Many times unless there
is a ton of publicity in these cases or blatant disregard for the law
then prosecutions seem to be rare. You can do anything it is the
morale and legal issues that you must deal with as an individual, as a
professional its the damage to your reputation or loss of trust from
colleagues and the public that is of concern and in the legal arena
you have to deal with the repercussions of your actions. Can you do
it? Yes. Is it legal? Probably not. What will happen if you do it?
That depends on your intent and purpose and who knows that you did it.
Just my thoughts and comments. You are right none of the large banks
security systems have audio and in most cases audio is illegal without
notifying the parties prior to entrance to the facilities. So if you
have audio on your own property are you breaking the law? It is your
domain but do these rules enter into your own home? Reasonable
expectation of privacy I believe again to be the answer to this but I
could be wrong.
Dan valid point also if you transmit in the clear I would think you
are giving up your reasonable expectation of privacy but the FCC does
not see it that way.
