A stack of Summons and Subpoenas were issues and the witnesses actually
refused to show up.
The arrest warrant was found to be fictional, they never had an arrest
warrant, and the document they claimed was an arrest warrant had no
signature on it of a judge or magistrate (which under U.S. Law they
actually have to obtain before the arrest). So essentially I was
arrested on a fake warrant (I have a copy of the fake warrant), and the
office claimed to have a warrant which indeed he had no such thing.
Oh-My, can you spell "Civl Rights Infringement", "Kidnapping", "False
Arrest". Then when the discovered that I havd been arrested on a fake
warrant then scrambled to confect a second case to try to hide the fake
warrant and the lack of probable cause on the first case (which was just
dismissed), then in the middle of this they (the Rockport Police) find
out that not only did the goods ship, but the customer form Switzerland
actually had the goods in hand. Of course Rockport Police, and the DA
withheld this information until about a month ago, and everything
suggests that they intended to hide this information at all costs. The
government knew that had no case the whole time, and they knew the whole
time that none of the witnesses woudl show up, but what really sunk them
is that I had tens of thousands of pages of evidence, and statutes, and
laws, and treaties, (and hundreds of past REI order were they did
improper exports, but were claiming they were getting licenses, which
they were not) that proved that I was the only honest person in the
transaction.
They had no probable cause
The arrest warrant was not signed by the court
The concealed evidence that proved I did nothing wrong
They concealed proof that the customer actually got the goods
There is proof the FBI was partially pulling the strings of the local cop
Then there was irrefutable proof that even though I was jumping though
hoops to get end user letters and suppling them with the orders that REI
was not actually obtaining the required license to perform the exports
lawfully, and hence they were smuggling arms in a huge way (and the
customer in Switzerland was also smuggling arms as they had no license
to import these arms. This is all laid out in detail in the Federal
Civil Right (and Racketeering, Arms Smuggling, ITAR violation) lawsuit.
Yes, I knwo the lawsuit is 2174 pages, but if you are in the TSCM
business you need to read it, and search out certain key points and details.

for 2 1/2 years. Atkinson's attorney, Paul Andrews of Denner and
Pellegrino LLP in Boston, said the state didn't have probable cause to
charge Atkinson in the first place.<br>

Atkinson's initial arrest came after a complaint from GAZ Turbine
Services, a Swiss firm that produces technology and equipment for the
oil and gas industry.<br>
<br>
The Swiss company had contacted the Chamber in an attempt to find out
if Atkinson's purported Granite Island Group was a real business. The
caller told the Chamber that his company purchased surveillance
equipment from Atkinson's company for over $32,000, but that it never
arrived, according to a report written by Rockport officer Daniel
Mahoney. The Chamber contacted police.<br>

Atkinson reiterated Thursday that his company serves as a go-between
for companies looking to purchase counter surveillance technology and
companies that make it.<br>
<br>
GAZ Turbine paid him $32,000 for the equipment, and he sent the money
to Tennessee-based Research Electronics International. That company
manufactures and ships the counter surveillance equipment. Without
proper export documents stating the end user of the electronics,
Atkinson said, the company can't ship them.<br>
<br>
According to Andrews' motion to dismiss the charges, GAZ ordered the
equipment in October 2009. Soon after, Atkinson paid REI for the
equipment, but REI said it needed a letter declaring the end user of
the electronics. GAZ didn't send that letter until Nov. 23, according
to court documents.<br>
<br>
Stephen Spring of Spring and Spring LLP in Louisiana, Atkinson's second
attorney, said the charges shouldn't have been brought forward in the
first place.<br>
<br>
"(GAZ) used the police department for extortion, threatening criminal
charges when they're the ones who didn't supply the proper documents,"
Spring said.<br>
<br>
Andrews' motion also cited that, during Rockport Police's
investigation, Atkinson and his attorneys stated that when Mahoney
called him, he did so on a recorded line. A line, they stated, Mahoney
didn't state was recorded until about seven minutes into the
conversation.<br>
<br>
Atkinson will face trial in Salem District Court on a total of 16 other
charges stemming from his arrest, including several charges of
possessing firearms and ammunition without a license, and possessing
high-capacity firearms. Drug charges and an allegation that he
illegally possessed a rocket launcher have also been dismissed.<br>
<br>
He is also representing himself in his own civil rights suit targeting
the town of Rockport and other defendants in the first Circuit Court of
Appeals.<br>
