LPD BUGGING ARRAIGNMENT: Officers Plead Not Guilty Part II
Hundley and three other former officers all entered pleas of not
guilty after being indicted last month by a grand jury.
The former police chief was the only officer who showed up in person
at the Lafayette Parish Courthouse.
Michael Lavergne, Brian Butler and Shannon Hundley all entered
written pleas of not guilty through their attorneys.
The group is accused of placing and monitoring an illegal listening
device inside the chief's secretary's office.
As expected, all of the former officers charged in the bugging case
have pleaded not guilty.
Former Lafayette police Chief Randy Hundley was the only officer to
enter his plea in person.
Michael Lavergne, Brian Butler and Shannon Hundley issued written
pleas of not guilty.
The criminal case started after a secretary filed a complaint with
the district attorney's office.
Randy Hundley has also filed another motion that could have a major
impact on the case.
Hundley is asking that District Attorney Mike Harson be recused from the trial.
The motion states the district attorney met with Hundley and two
other people before the investigation started.
It claims Harson studied the law and gave verbal advice to Hundley.
It goes on to state that the criminal complaint at the heart of the
case consisted of the same facts talked about during their meeting.
When asked what the defense is hoping for with the prosecution,
here's what Hundley's attorney had to say.
Jason Robideaux says they just want somebody who could be fair and
doesn't have an interest in the case.
TV 10 told Harson about the new motion while he was at his annual
charity golf tournament.
He says the meeting with Hundley and two others took place, but it
shouldn't have an impact.
Mike Harson says there were some general discussions about the
statutes that applied and they had questions about what they had done
a year-and-a-half before, as to whether it was legal or not. He says
he doesn't know if any of that was made in the form of legal motion.
Robideaux says the state attorney general's office would take over
prosecution if the motion is successful.
He says he hopes the motion is taken up before a pre-trial hearing
scheduled for September.
Michael Lavergne has also filed a motion to dismiss the charges.
Lavergne's lawyers claim a secretary within the police department
should not expect privacy while in her office.
