President Bush's warrantless surveillance program=20
took another surprise turn last week when a team=20
of FBI agents, armed with a classified search=20
warrant, raided the suburban Washington home of a=20
former Justice Department lawyer. The lawyer,=20
Thomas M. Tamm, previously worked in Justice's=20
Office of Intelligence Policy and Review=20
(OIPR)=97the supersecret unit that oversees=20
surveillance of terrorist and espionage targets.=20
The agents seized Tamm's desktop computer, two of=20
his children's laptops and a cache of personal=20
files. Tamm and his lawyer, Paul Kemp, declined=20
any comment. So did the FBI. But two legal=20
sources who asked not to be identified talking=20
about an ongoing case told NEWSWEEK the raid was=20
related to a Justice criminal probe into who=20
leaked details of the warrantless eavesdropping=20
program to the news media. The raid appears to be=20
the first significant development in the probe=20
since The New York Times reported in December=20
2005 that Bush had authorized the National=20
Security Agency to eavesdrop on the international=20
phone calls and e-mails of U.S. residents without=20
court warrants. (At the time, Attorney General=20
Alberto Gonzales said of the leak: "This is=20
really hurting national security; this has really hurt our country.")
A veteran federal prosecutor who left DOJ last=20
year, Tamm worked at OIPR during a critical=20
period in 2004 when senior Justice officials=20
first strongly objected to the surveillance=20
program. Those protests led to a crisis that=20
March when, according to recent Senate testimony,=20
then A.G. John Ashcroft, FBI Director Robert=20
Mueller and others threatened to resign,=20
prompting Bush to scale the program back. Tamm,=20
said one of the legal sources, had shared=20
concerns about he program's legality, but it was=20
unclear whether he actively participated in the internal DOJ protest.
The FBI raid on Tamm's home comes when Gonzales=20
himself is facing criticism for allegedly=20
misleading Congress by denying there had been=20
"serious disagreement" within Justice about the=20
surveillance program. The A.G. last week=20
apologized for "creating confusion," but Senate=20
Judiciary Committee chair Sen. Patrick Leahy said=20
he is weighing asking Justice's inspector general=20
to review Gonzales's testimony.
The raid also came while the White House and=20
Congress were battling over expanding NSA=20
wiretapping authority in order to plug purported=20
"surveillance gaps." James X. Dempsey of the=20
Center for Democracy and Technology said the raid=20
was "amazing" and shows the administration's=20
misplaced priorities: using FBI agents to track=20
down leakers instead of processing intel warrants=20
to close the gaps. A Justice spokesman declined to comment.
