I believe he's covered under FCC statutes, he does however, have to NOT reveal what he heard.

Ogdensburg man arrested for eavesdropping at SLC Court complex

St. Lawrence County Sheriff's detectives arrested an Ogdensburg man
for felony eavesdropping at the County Court complex in Canton.

Authorities allege that in January of this year 49-year-old Ronald J.
Driscoll, while working as a technician for Citizen Phone Company
working on the lines at the County Court complex, intentionally
listened in on a conversation between two county employees without
their consent.

Driscoll was issued an appearance ticket for the village of Canton
court for March 7th.
