Lawyer sues Bush over surveillance
ATLANTA, Jan. 21 (UPI) -- A Georgia Department of Corrections lawyer
has filed a lawsuit challenging the constitutionality of President
George W. Bush's warrantless surveillance.
Mark Guzzi of Alpharetta told the Atlanta Journal-Constitution he was
acting as a private citizen. His suit claims the surveillance
violates the Fourth Amendment guarantee against unreasonable search
and seizure.
The American Civil Liberties Union and other groups have also sued.
Guzzi's suit names the president, the National Security Agency and
the NSA director.
Stephen Bright, a Yale Law School professor, said the suit is likely
to be dismissed because Guzzi cannot prove he has been under surveillance.
"It's a Catch 22," Bright said. "The government will argue that he
can't prove that they are eavesdropping, but the government will not
admit whether they're eavesdropping on him or not. I would hope a
judge would reject that argument."
Guzzi said he has friends overseas -- including an Iranian woman now
living in Canada -- with whom he exchanges e-mail and discusses
current events, including terrorist attacks. He believes those
e-mails are likely to have put him under surveillance.
