#19 HR669 (Confiscation!) The following is the complete text oh HR669, which would ban "assault" rifles and confiscate them WITHOUT compensation (violation of 4th Amendment!). H.R. 669 To prohibit the transfer or possession of assault weapons IN THE HOUSE OF REPRESENTATIVES January 27, 1989 Mr. Berman introduced the following bill; which was referred to the Committee on the Judiciary A BILL -- To prohibit the transfer or possession of assault weapons. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. PROHIBITION AGAINST TRANSFER OR POSSESSION OF ASSAULT WEAPONS. (a) IN GENERAL.--Section 922 of title 18, United States Code, is amended by adding at the end the following: "(p)(1)(A) Except as provided in subparagraph (B), it shall be un- lawful for any person to transfer any assault weapon. "(B) Subparagraph (A) shall not apply to the surrender of any assault weapon to any Federal, State, or local law enforcement officer. "(2) It shall be unlawful for any person to possess any assault weapon on any day which is 30 or more days after the date of enactment of this subsection.". (b) ASSAULT WEAPON DEFINED. -- Section 921(a) of such title is amended by adding at the end the following: "(25)(A) Except as provided in subparagraph (B), the term 'assault weapon' means any of the following: "(i) Any semiautomatic center fire rifle that accepts a detachable magazine with a capacity of 20 or more rounds of ammunition. "(ii) Any shotgun which has a barrel of less than 19 inches in length and a folding stock or magazine capacity of more than 6 rounds of ammunition. "(iii) Any firearm which has a barrel of less than 12 inches in length, that is -- "(I) a modification of any rifle described in clause (i) and has the same make, caliber, and action design as, but has a shorter barrel than, such rifle and has no rear stock; or "(II) a semiautomatic weapon originally designed to accept a magazine with a capacity of 20 or more rounds of ammunition. "(iv) Any of the following specific firearms or copies of such firearms: "(I) Any pistol or carbine known as an 'Uzi'. "(II) Any Ingram MAC 10 or 11 pistol or carbine. "(III) Any semiautomatic rifle of military style known as an 'Avtomat Kalashnikov' or a 'Kalashnikov'. "(IV) Any shotgun of the type known as a 'street sweeper'. "(v) Any firearm which may be readily restored to be an operable weapon described in a preceding clause of this subparagraph. "(vi) Any part or combination of parts, designed or intended to convert a firearm into a weapon described in any other clause of this subparagraph, or any combination of parts from whic such a weapon may be readily assembled if such part or parts are possessed or controlled by the same person. "(B) The term 'assault weapon' does not include any of the following: "(i) Any weapon that does not use fixed ammunition. "(ii) Any weapon that was manufactured before the calendar year 1898. "(iii) Any manually operated bolt action weapon that is not a semiautomatic weapon. "(iv) Any lever action weapon that is not a semiautomatic weapon. "(v) Any slide action weapon that is not a semiautomatic weapon. "(vi) Any multiple barrel weapon that is not a semiautomatic weapon. "(vii) Any revolving cylinder weapon that is not a semiautomatic weapon. "(viii) Any semiautomatic weapon with a fixed magazine capacity of 10 or fewer rounds of ammunition. "(ix) Any semiautomatic weapon that uses exclusively Mannlicher style clips. "(x) Any semiautomatic weapon manufactured before 1954. "(xi) Any rimfire weapon that employs a tubular magazine. "(xii) Any short-barreled shotgun or short-barreled rifle used solely as a prop for motion picture film or television program production. "(xiii) Any firearm that uses .22 caliber rimfire ammunition. "(xiv) Any weapon described in subparagraph (A) which has been modified so as to -- "(I) permanently render such weapon inoperable; or "(II) make such weapon permanently a device that is not a weapon described in any clause of subparagraph (A). "(C) As used in this paragraph: "(i) Notwithstanding paragraph (5), the term 'shotgun' means a weapon, whether or not intended to be fired from the shoulder, that is designed or redesigned, made or remade, to fire a fixed shotgun shell. "(ii) Notwithstanding paragraph (7), the term 'rifle' means a weapon, whether or not intended to be fired from the shoulder, that is designed or redesigned, made or remade, to fire a fixed cartridge and has a barrel of 12 or more inches in length. "(iii) The term 'semiautomatic', when used with respect to a weapon, means a weapon which fires a single projectile for each single pull of the trigger and emplys a magazine.". (c) EFFECTIVE DATE -- The amendment made by subsection (a) shall apply to conduct engaged in after the date of the enactment of this Act. That's it, folks. This bill is so convoluted and has such tricky wording that it could classify virtually ANY semi-auto an "assault" weapon.
