MILITIA HYSTERIA HITS HOME HARD

      Kansas City family suffers loss of its father's income for
political speech.  Friends and family of Mike Hurley, a former
candidate and Libertarian Party official, were shocked and appalled
when the Missouri State Highway patrol cut short his full-time
National Guard assignment for political reasons.  In a report issued
to the Counternarcotics Office, HQ STARC, Missouri Army National
Guard, the Patrol branded Specialist Hurley with "militia
tendencies."  The Patrol requested Hurley's immediate dismissal.
Hurley is a career member of the National Guard.

     The report concerned a private conversation between Hurley and
a Patrol investigator who also worked in Hurley's office.  The
report suggests the militia hysteria, currently the rage in some
political circles, has infected the Missouri State Highway Patrol.
Here is a summary of observations leading to classifying Hurley as
having militia tendencies:

1)  Hurley considered the assault weapons ban to be of dubious
value.

2)  Hurley echoed national concerns about an apparent trend within
the BATF to hurt innocent people either through incompetence or by
blatantly violating the law.

3)  Hurley showed some knowledge of Supreme Court decisions and the
Constitution.

4)  Hurley expressed knowledge of and concern for the tragedy at
WACO and the horrific bombing in Oklahoma City, including criticisms
of current official versions of these events.

5)  Hurley mentioned he knows Harold Sheil of Kansas City North,
Public Information Officer for the 51st Militia and a retired Kansas
City Fire Department Battalion Chief.

6)  Hurley has an America Online account which includes Internet
E-mail access, exposing him to varying opinions and viewpoints,
including those at variance with government officials.

      Hurley believes the above points make up a "militia profile"
similar to controversial "drug profiles" now popular with law
enforcement agencies. Paul Lamoree, a Kansas City lawyer, stated, "I
had no idea the inflammatory but rather empty  rhetoric being used
by the President and members of his administration and political
allies had penetrated to the level of the people in the trenches,
such as local law enforcement.  The irrational nature of the
Patrol's action is chilling, indeed."

      Pattie Hurley, wife to SPC Hurley, also shocked by Troop's
decision, commented, "This just shows how bad things really are.
They [government officials] don't even want us to know about certain
things."  SPC Hurley added, "They [the Patrol] seem incensed that I
simply knew something about the law. Maybe these guys have seen
'Judge Dredd' once too often."

      Hurley's job with Troop A was part of the Drug
Eradication/Interdiction Support Program.  As a support person for
Troop A, SPC Hurley was full time Army, with full active duty pay
and benefits, but also attended drill with his National Guard Unit.
When Troop A withdrew its request for Hurley's support services, he
was automatically terminated from ADSW by the National Guard's
Counternarcotics Office in Jefferson City.  Hurley's superior at the
Counternarcotics office told him that he had done nothing wrong.  He
also said the Patrol's action need not impair his National Guard
career, depending on if and how far he might pursue his grievance.
