After the first nine months, a judge will rule in favor of a psychological parent over a biological parent. Like any legal action, possession is 9/10ths of the law. Time is running out for Birkhead as Dannielynn is already over 5 months old, and once a baby reaches six months it is quite possible to get judges to rule in favor of the "psychological parent.
