CARENCRO, La. -- A Lafayette Parish man is accused of raping a 92-year-old woman who lived at the nursing home where he was an employee.

The arrest report said other workers saw Donovan Martell Despanie, 19, having sex with the woman, who has dementia. The report also said Despanie has admitted to the crime.

He was arrested Friday and is in the parish jail Sunday on $250,000 bond.

Carencro Police Chief Carlos Stout said the state attorney general's office is assisting in the investigation because the rape occurred at Evangeline Oaks of Carencro Guest House, a state-licensed nursing home.

Despanie had been employed at the nursing home for about two months, after completing training on working with the elderly.

The state's attorney general's office is looking into the [size=4][color=red]alleged[/color][/size] rape of a 92-year-old nursing home patient by a 19-year-old orderly.

According to Carencro Police Chief Carlos Stout, the state is checking to make sure the state-regulated nursing home, Evangeline Oaks, didn't violate any policies or procedures in the case.

19-year-old Donovan Despanie claims the sex was consentual, but the nursing home resident was diagnosed with dementia.

Despanie is being held in the parish jail on a $250,000 bond.

Who would believe that a 92 year-old woman with dementia would have the capacity to consent to sex. Obviously, even if she did "consent" she doesn't even know what she is doing. I hope they try to sell that to the Jury. The Prosecuting Attorney would kill any kind of crazy defense of that nature.
