The High Court has granted leave to a Nigerian woman to bring a legal challenge to prevent the deportation of herself and her two children, one of whom has been diagnosed with Attention Deficit Hyperactivity Disorder.

Olivia Agbonlahor, with an address in Clonakilty in Co Cork, had claimed the deportation to Nigeria would adversely affect her five-year-old son, Great, who has ADHD.

She claims the boy would be treated as an outcast because of his condition.


Mr Justice Daniel Herbert granted leave on the sole ground that on the evidence before him last January the decision of the Minister for Justice not to revoke the Deportation Order was a violation of their rights under Article Eight of the European Convention of Human Rights.
