Anti-racism activist wins libel judgment
'Diatribe and insults' by white-supremacist showed malice, judge rules

Ottawa anti-racism campaigner Richard Warman has won a $30,000 libel judgment against a persistent antagonist for defamatory Internet postings he characterizes as "an oil spill on my reputation." In a ruling yesterday, Ontario Superior Court Justice Monique Métivier ordered Paul Fromm, director of the Canadian Association for Free Expression, to pay $20,000 in general damages and a further $10,000 in aggravated damages for nine defamatory postings about Mr. Warman.

Judge Métivier also ordered Mr. Fromm, whose teaching certificate was revoked this month by the Ontario College of Teachers for professional misconduct related to his white-supremacist activism and views, to post full retractions on all the websites on which he posted the defamatory comments within 10 days.

Mr. Warman, who has had 10 complaints about Internet hatred upheld by the Canadian Human Rights Tribunal in recent years, sued Mr. Fromm for postings that characterized him, among other things, as an enemy of free speech, a member of the thought police and a "high priest of censorship." The comments were posted on a site called Freedomsite.org using a server located in the United States. Many were also republished on the Canadian Heritage Alliance site. Both sites espouse far-right views.

Mr. Warman expressed relief at the ruling. "Justice Métivier's decision has said that these baseless attacks against me were malicious and false," he said.

Mr. Fromm's dominant motive, Judge Métivier said in her ruling, was to attack Mr. Warman personally in retaliation for his use of legal processes to restrain illegal speech.

She found that Mr. Fromm's comments were designed to hold Mr. Warman up to ridicule. He published them, she said, "either knowing the fundamental falseness of the accusations he levelled at Mr. Warman, or being reckless as to the truth of these." This "steady diet of diatribe and insults, couched in half truths and omissions" amounted to malice on Mr. Fromm's part, she said. "Given the instant and possibly global dissemination of messages over the Internet, the damage may continue for years." Judge Métivier noted that Mr. Warman is a lawyer, a profession for which a reputation for integrity and trustworthiness is imperative. "His professional reputation continues to be of paramount importance to him now and in the future."

This decision comes as no surprise and demonstrates (as if further proof was needed) that freedom of expression is absolutely dead in the People's Republic of Canada. Don't for one minute expect justice from Canadian courts. They are of the same mind as Warman--you can say or write whatever you want as long as it is in line with the mainstream socialist orthodoxy. Warman can muzzle a few people through Canada's socialist courts but, fortunately, he can't suppress the truth in other countries or on the Internet. And the truth is that he is a Stalinist censor who is determined to suppress freedom of expression and dissent from his totalitarian line. If he is widely held in contempt, it is for good reason. Through his attempts to suppress political dissent, he has already hopelessly damaged his reputation. They don't call him Canada's "censorship champion" for nothing. Sooner or later, real justice is going to catch up with Comrade Warman. I can't wait for that to happen.
