Terry Tremaine is scheduled to make his first court appearance Feb. 25.
Accused hate-monger says he's eager for trial
Monday, January 28, 2008
A Regina man accused of promoting hatred on the internet is welcoming the chance to air his views in court.
Terry Tremaine, 59, who was at one time a math instructor with the University of Saskatchewan, was charged by the Regina police last week.
Police allege that earlier in decade he used the internet to wilfully promote hatred against Jews.
In an interview Monday,Tremaine said he will use the criminal proceedings as a platform for his views. He wants all Jews to leave Canada, calling them a "destructive force" in society.
"We want to see the issue of race put back on the table in this country. And this trial will do so," he said. "It will become a point of discussion in Canada again."
Tremaine's writings on the internet led to a complaint that took police 18 months to investigate.
"I was surprised that they charged me, because the trial will be a platform and I'm surprised that they took the chance of giving me such a platform," he said.
Tremaine said he has been told not to acquire a computer to replace the one police seized last summer. He's also been ordered to stay off the internet.
He said he is following those conditions.
Tremaine also said he is working on getting legal assistance in time for his first court appearance in February.

Former U of S lecturer pleads not guilty to promoting hatred against Jews

REGINA -- A former University of Saskatchewan lecturer says he's not guilty of promoting hatred against Jews, and wants to take his case before a jury.
"I say I'm promoting the truth ..." Terrence Cecil Tremaine told reporters outside Regina Provincial Court on Monday. "We're in a situation in this country where someone had to speak out, and I decided it had to be me."
Tremaine was charged last month for allegedly violating a section of the Criminal Code that bars public incitement of hatred against any identifiable group.

Terrence Tremaine
A conviction carries a penalty of up to two years in jail.
Tremaine was dismissed from his position as a part-time lecturer at the University of Saskatchewan in 2005, after the school became aware of postings he had made on a white supremacist Web site.
After his dismissal, Tremaine, known online as mathdoktor99 and JCMateri, attributed his anti-Jewish comments to mental health issues and delusional thinking, but subsequently retracted that explanation and stood by his earlier Internet postings.
Last year, the Canadian Human Rights Tribunal ruled that Tremaine had violated the Canadian Human Rights Act by making racist postings on the Internet. The tribunal fined Tremaine $4,000 and ordered him to stop making such postings.
The new postings are alleged to have been made between Feb. 1, 2004, and Nov. 1, 2007.
Tremaine made his first appearance on the new charge at Regina Provincial Court Monday morning.
The 59-year-old appeared without a lawyer, and entered a not-guilty plea. The case was adjourned two weeks for Tremaine to get disclosure, and for the Crown to look into removing a court-order that bars Tremaine from having access to the Internet and computers.
Tremaine told court he needs Internet access to prepare his case. He also said he would like his case heard by a jury.
Outside court, Tremaine told reporters he was taking a stand against the Jewish community's "inordinate amount of power" in Canada.
He also said his writings have all been on American servers, and that jurisdiction may be an issue in his defence.
When questioned about his view on other races, Tremaine told reporters he believes whites have a right to Canada, and that any aversion to his beliefs may be the product of decades of media propaganda.
Tremaine is slated to be back in court on March 10.

Regina Man Seeking Changes
To Release Conditions
Leader-Post
Monday, March 10, 2008
REGINA -- A Regina man charged with wilful promotion of hatred says his release conditions are keeping him from work.
Terrence Cecil Tremaine appeared briefly in Regina Provincial Court on Monday morning. He's accused of posting Internet messages that are hateful against an identifiable group between Feb. 1, 2004 and Nov. 1, 2007.
When Judge Dennis Fenwick asked what the 59-year-old wanted to do with the charge -- to which he pleaded not guilty last month -- Tremaine said he wanted to submit a motion to the court.
He was cut short by Fenwick, who first wanted to know what the motion might be about. Tremaine said he had three requests: About altering his release conditions; having the charges dismissed; and seeking a further adjournment.
When Fenwick suggested Tremaine talk to the prosecutor about changes to his release conditions, Tremaine replied, "They're fairly intransigent."
Fenwick then tried to simply adjourn the matter, since Tremaine said he is trying to arrange for a lawyer.
"I haven't made a final decision," the accused said.
However, Tremaine went on to explain that Legal Aid is having trouble assessing his application because of his current job situation.
One of Tremaine's release conditions, imposed by a justice of the peace following his arrest in January, prohibits him from having access to the Internet and computers. But because the former University of Saskatchewan lecturer is working at a call centre -- which requires the use of a computer -- Tremaine is currently on leave.
Fenwick asked Crown prosecutor Loreley Berra about a change in the conditions that might allow Tremaine to use a computer specifically for work.
She said the offences allegedly occurred primarily on a home computer, but the prosecution remains concerned about any access to a computer.
In the end, Fenwick adjourned the matter to April 8.
"I think that's in your interest if you're going to have a lawyer," said Fenwick, explaining a lawyer could then address Tremaine's motion.
During his previous court appearance, Tremaine told reporters he was simply taking a stand against the Jewish community "power" in Canada and disputes having committed a criminal act.

There are very few Canadians that I would say are more gutsy than I am. Terry Tremaine is one of them.
I've said/wrote it before and I'll say/write it again. Fired and oppressed teachers in our 'free' and 'democratic' Canada, ought to get together with other teachers disgusted with our 'educational' system and start Whites only private schools.

Regarding the arrest of Terry Tremaine in Canada for thought crimes, the Canadian Parliament regards protecting racial, religious and other minorities from being offended as more important than the right to free speech. Therefore, it enacted the Human Rights Act to more easily ferret out dissidents and see to it that they are prosecuted.
The Canadian Charter Article 1 provides that the Charter ”guarantees the rights and freedoms set out in it subject only to such reasonable limits prescribed by law as can be demonstrably justified in a free and democratic society” and this has been interpreted by the Canadian courts and Human Rights Commission in a such manner which makes its constitutional guarantee of free speech pretty much meaningless when compared to other "collective rights and interests". It is utterly useless in protecting free speech when that speech might offend someone, especially if it is considered the untimate no-no, "hate speech". It states:
"Although freedom of expression is an important fundamental value, we in Canada value just as much the equality rights of all individuals. Equality means a respect for the inherent dignity of all human beings whatever their colour, race, language, sex or religion. Freedom to express one’s idea ceases to be freedom of expression or opinion when it is used to stand in the way of the promotion of equality. Freedom of expression ceases to be a fundamental characteristic of democratic values when it becomes a vehicle for the promotion of hate."
The US Constitution’s First Amendment is different..so far..as it guarantees freedom of speech very directly, and it has been long interpreted not to permit any law which abridges free speech unless that speech is appropriately dangerous to life or limb or libelous. The John Paul Zenger trial in 1735 set the president and gave birth to a free and open press in America (within a half-century members of the First Congress debated the proposed Bill of Rights). Of course those age old tenets of a free society are in grave danger today because of only one issue: the so-called holocaust. This exception to our cherished legal notions is what is (to use the words of a popular Revolutionary War song) "turning the world upside down" today.
Anyway, the Terry Tremaine situation brings to mind that well-loved, patriotic 1943 American children's book aptly named "Johnny Tremain" by Esther Forbes. Set during the time of the American revolution, the main character of the book, Johnny Tremain, is an apprentice silversmith and painfully injures his hand. Johnny is rescued by a kind family who owns a hand-operated printing press and publishes a newspaper (ala John peter Zenger). Johnny meets and befriends another young man who becomes his best friend and role model and who introduces him to radical political views in Boston on the eve of the revolution. Young Tremain becomes part of the printshop, and delivers papers to the people of Boston, joining the Sons of Liberty along the way and befriending several historical figures including Paul Revere, Samuel Adams, John Hancock, and Joseph Warren. The novel includes historical events like the Boston Tea Party and the famous run by Paul Revere. There are parallels to be drawn.
Our enemy is not so obvious as the enemy of the Sons of Liberty. He is a masked bandit, an insidious villain who creeps into our cherished legal traditions and undermines them to avoid close scrutiny of his own nefarious activities.
