If all goes according to plan, an otherwise stately federal courtroom in downtown Los Angeles will be converted into a makeshift movie theater this week, screening a series of graphic -- many would say vulgar -- sexual fetish videos.

At issue is how a jury will define obscenity in a region that boasts its status as the capital of the pornography industry and at a time when technology has made the taboo adult flicks of a generation ago available to a mainstream audience.

Hollywood filmmaker Ira Isaacs says the videos he sells are works of art, protected under the Constitution. Federal prosecutors contend they are criminally obscene.

The prosecution is the first in Southern California by a U.S. Department of Justice task force formed in 2005 after Christian conservative groups appealed to the Bush administration to crack down on smut.

For jurors to determine whether Isaacs' work is obscene, they will view hours of hard-core pornography so degrading that in one film, an actress cries throughout, prosecutors said in court papers.

But if jurors find that any of the four videos at issue in the case have any "literary, scientific or artistic value," the work is not legally obscene, according to a 1973 Supreme Court ruling.

"All they're going to do is turn on a DVD machine and hope the jury is going to be so shocked and disgusted and offended that they're going to throw me in prison," said Isaacs, 57, a native of the Bronx. He said he hopes that jurors will be shocked -- he's a self-described "shock artist" -- but also that they will see artistic value in the work.

The portly defendant, who sports a ponytail and goatee, produced and starred in one of the videos. He contends that the sex in the movie is incidental to the art. It's merely a marketing tool to drive sales of the videos on the Internet, he said.

In a statistic that some may find every bit as shocking as his work, Isaacs said he was selling about 1,000 videos per month at $30 apiece before being raided by the FBI early last year. The number has since dropped to between 700 and 800 per month, but they still generate enough money to pay the rent on a house with a pool in the Hollywood Hills.

Isaacs predicted that many jurors would not be able to stomach viewing the movies, some of which feature acts of bestiality and defecation.

"It's going to be a circus," he said of the upcoming trial. "I think I'd freak out if I had to watch six hours of the stuff."

Jury selection is expected to begin today. Presiding over the trial will be Alex Kozinski, chief judge of the 9th Circuit Court of Appeals. Kozinski was assigned the case as part of a rotation in which he and other appeals court judges occasionally oversee criminal trials in addition to deciding appeals.

His involvement in the case may be a stroke of luck for Isaacs. That is because Kozinski is seen as a staunch defender of free speech. When he learned that there were filters banning pornography and other materials from computers in the appeals court's Pasadena offices, he led a successful effort to have the filters removed.

"I did some rabble-rousing about it," Kozinski said in a brief interview last week. He said he was made aware of the issue when a law clerk researching a case was banned from accessing a gay bookstore's website.

"I didn't think the bureaucrats in Washington should decide what the federal judiciary should have access to," the judge said. "I thought that was incredibly arrogant for them to decide on their own."

Kozinski declined to comment on any aspect of the Isaacs case.

Isaacs said he would testify as his own expert witness at trial and planned to lecture jurors on how perceptions of art have changed over the years. There was a time, he said, when the works of authors James Joyce and D.H. Lawrence were called obscene.

The point, Isaacs said, "is do we really want to throw artists in jail in America?"

Kenneth Whitted, the Justice Department prosecutor assigned to the Obscenity Prosecution Task Force, declined to be interviewed for this report.

According to the Justice Department's website, the task force "is dedicated exclusively to the protection of America's children and families through the enforcement of our Nation's obscenity laws."

Obscenity will eventually be defined as "the truth," and anything else, including fagdom and beastiality will be expressions of art.

The reason I mentioned atheists is because there is nothing from a spiritual standpoint to stop them from harming another. I know Christian racists have done the same thing. LOS ANGELES - What violates community obscenity standards in the nation's reputed pornography capital? Federal prosecutors think they have a case.

Ira Isaacs readily admits he produced and sold movies depicting bestiality and sexual activity involving feces and urine. The judge warned potential jurors that the hours of fetish videos included violence against women, and many of them said they don't want to serve because watching would make them sick to their stomachs.

"It's the most extreme material that's ever been put on trial. I don't know of anything more disgusting," said Roger Jon Diamond - Isaacs' own defense attorney.

The case is the most visible effort of a new federal task force designed to crack down on smut in America. Isaacs, however, says his work is an extreme but constitutionally protected form of art.

"There's no question the stuff is disgusting," said Diamond, who has spent much of his career representing pornographers. "The question is should we throw people in jail for it?"

Isaacs, 57, a Los Angeles advertising agency owner who says he used to market fine art in commercial projects, calls himself a "shock artist" and says he went into distributing and producing films about fetishes because "I wanted to do something extreme."

"I'm fighting for art," he said in an interview before his federal trial got under way. "Art is on trial."

He plans to testify as his own expert witness and said he will cite the historic battles over obscenity involving authors James Joyce and D.H. Lawrence.

One of his exhibits, he said, will be a painting of a urinal by famed artist Marcel Duchamp.

Diamond said Isaacs also will tell jurors the works have therapeutic value for people with the same fetishes depicted on screen.

"They don't feel so isolated," Diamond said. "They have fetishes that other people have."

Isaacs makes a brief appearance in one of the videos he produced; others that he distributed were imported from other countries.

The business has been lucrative. At one point, he has said, he was selling 1,000 videos a month at $30 apiece. Then his office was raided by FBI agents who bought his videos online with undercover credit cards.

The government obtained an indictment against Isaacs on a variety of obscenity charges, including importation or transportation of obscene material for sale. Prosecutors have declined to comment about the case.

Jean Rosenbluth, a former federal prosecutor and law professor at University of Southern California, said such prosecutions were rare until the creation of the U.S. Department of Justice Obscenity Prosecution Task Force. Child pornography cases are handled by a separate unit.

"The problem with obscenity is no one really knows what it is," she said. "It's relatively simple to paint something as an artistic effort even if it's offensive."

The test of obscenity still hinges on a 1973 U.S. Supreme Court ruling which held that a work is not legally obscene if it has "literary, artistic, political or scientific value."

Jurors also are asked to determine whether the material in question violates standards of what is acceptable to the community at large.

"This task force was quite controversial and many in the Department of Justice felt that it was a waste of resources," Rosenbluth said. "Because of the pressure, they seem to have chosen the worst cases they can find to prosecute."

Each of the six counts against Isaacs carries a five-year maximum prison sentence. Prosecutors also are seeking forfeiture of assets obtained through his video sales.

"A lot of this is about sending a message - 'Don't make this stuff. Don't put it on the Internet. We don't want it here,"' Rosenbluth said.

Rosenbluth said prosecutors would be emboldened to pursue similar cases if Isaacs is convicted, though there would be lengthy challenges on appeal.

In an unusual twist, the trial is being presided over by the chief judge of the 9th U.S. Circuit Court of Appeals, Alex Kozinski, under a program that allows appellate judges to occasionally handle criminal trials at the District Court level. Kozinski is known as a strong defender of free speech and First Amendment rights.

When jury selection began Monday, he urged prospects to be open about their opinions and incurred an onslaught of negative statements. Within the first hour, he dismissed 26 men and women who said they could not be fair to the defendant because they were repulsed by the subject matter. By day's end, half the panel of 100 had been excused.

"I think watching something like that would make me physically ill, nauseous," said one woman. "It's affecting me physically now just thinking about it."

One man fired angry comments at the ponytailed Isaacs.

"Hearing stuff about feces made me sick and the defendant looks like my ex-business partner who did some of these things. He looks guilty as sin to me," said the man. "It turns my stomach thinking about it."

Several prospects marched up to the judge's bench for private conferences when he told them that the films also involved violence against women. They, too, were excused, as were several who cited their religious beliefs.

Asked how long they would have to watch the movies, Kozinski told them it would be about five hours and "I will be there watching with you. This is part of the job we're doing."

One of the highest-ranking federal judges in the United States, who is currently presiding over an obscenity trial in Los Angeles, has maintained his own publicly accessible website featuring sexually explicit photos and videos.

Alex Kozinski, chief judge of the U.S. 9th Circuit Court of Appeals, acknowledged in an interview with The Times that he had posted the materials, which included a photo of naked women on all fours painted to look like cows and a video of a half-dressed man cavorting with a sexually aroused farm animal. Some of the material was inappropriate, he conceded, although he defended other sexually explicit content as "funny."

Kozinski, 57, said that he thought the site was for his private storage and that he was not aware the images could be seen by the public, although he also said he had shared some material on the site with friends. After the interview Tuesday evening, he blocked public access to the site.

Asked whether the contents of his site should force him to step aside from the pending obscenity trial, Kozinski declined to comment. Opening statements in the trial are scheduled for this morning. In the case, Ira Isaacs, a filmmaker based in Los Angeles, is accused of distributing criminally obscene sexual-fetish videos depicting bestiality and defecation.

Stephen Gillers, a New York University law professor who specializes in legal ethics, told The Times that Kozinski should recuse himself from the Isaacs case because "the public can reasonably question his objectivity" concerning the issues at hand.

Gillers, who has known Kozinski for years and called him "a treasure of the federal judiciary," said he took the judge at his word that he did not know the site was publicly available. But he said Kozinski was "seriously negligent" in allowing it to be discovered.

"The phrase 'sober as a judge' resonates with the American public," Gillers said. "We don't want them to reveal their private selves publicly. This is going to upset a lot of people."

Gillers said the disclosure would be humiliating for Kozinski and would "harm his reputation in many quarters," but that the controversy should die there.

He added, however, that if the public concludes the website was intended for the sharing of pornographic material, "that's a transgression of another order."

"It would be very hard for him to come back from that," he said.

Kozinski said he would delete some material from his site, including the photo depicting women as cows, which he said was "degrading . . . and just gross." He also said he planned to get rid of a graphic step-by-step pictorial in which a woman is seen shaving her pubic hair.

Kozinski said he must have accidentally uploaded those images to his server while intending to upload something else. "I would not keep those files intentionally," he said. The judge pointed out that he never used appeals court computers to maintain the site.

The sexually explicit material on Kozinski's site earlier this week was extensive, including images of masturbation, public sex and contortionist sex. There was a slide show striptease featuring a transsexual, and a folder that contained a series of photos of women's crotches as seen through snug fitting clothing or underwear. There were also themes of defecation and urination, though they are not presented in a sexual context.

Kozinski, who was named chief judge of the 9th Circuit last year, is considered a judicial conservative on most issues. He was appointed to the federal bench by then-President Ronald Reagan in 1985. He has a national reputation for a brilliant legal mind and has developed a reputation as a champion of the First Amendment right to freedom of speech and expression. Several year ago, for example, after learning that appeals court administrators had placed filters on computers that denied access to pornography and other materials, Kozinski led a successful effort to have the filters removed.

The judge said it was strictly by chance that he wound up presiding over the Issacs trial in U.S. District Court in Los Angeles. Appeals court judges occasionally hear criminal cases when they have free time on their calendars and the Isaacs case was one of two he was given, the judge said.

Kozinski said he didn't think any of the material he posted on his website would qualify as obscene.

"Is it prurient? I don't know what to tell you," he said. "I think it's odd and interesting. It's part of life."

Before the site was taken down, visitors to http://alex.kozinski.com were greeted with the message: "Ain't nothin' here. Y'all best be movin' on, compadre."

Only those who knew to type in the name of a subdirectory could see the content on the site, which also included some of Kozinski's essays and legal writings as well as music files and personal photos.

The judge said he began saving the sexually explicit materials and other items of interest years ago.

"People send me stuff like this all the time," he said.

He keeps the things he finds interesting or funny with the thought that he might later pass them on to friends, he said.

LA obscenity trial suspended over judge's Web site

PASADENA, Calif. (AP) — A federal judge overseeing a case exploring the extreme fringe of pornography suspended the obscenity trial on Wednesday after a newspaper reported he had posted sexually explicit photos and videos on his own Web site.

Judge Alex Kozinski, chief judge of the 9th U.S. Circuit Court of Appeals, granted a joint prosecution and defense motion to suspend the trial after prosecutors said they needed time to look into the issue. The jury was ordered to return on Monday.

"I'm not going to say anything. The trial is ongoing," Kozinski told a reporter as he left.

The suspension came after jurors spent hours at the Pasadena offices of the 9th Circuit watching videos of bestiality and extreme fetishes that are evidence in the trial of Ira Isaacs, a Los Angeles businessman who sold them.

Kozinski indicated to the attorneys he would be willing to recuse himself but noted that the trial had already begun and jurors had already seen two of the graphic movies.

Earlier, as the jury was hearing opening statements in a Los Angeles courtroom, the Los Angeles Times reported on its Web site that Kozinski had posted sexual material on his Web site and then blocked access after being interviewed about it Tuesday evening.

Crowley also touched on it in several writings in "Book 4". Upon death, ones soul/ka/ba/spirit enters a universe that you, yourself, have created.

Only those who knew to type in the name of a subdirectory could see the content on the site, which also included some of Kozinski's essays and legal writings as well as music files and personal photos.

The judge said he began saving the sexually explicit materials and other items of interest years ago.


Does anyone know if this subdirectory would have been copied by the Wayback machine? Would the photographs be accessible? It would be great if these photos could be retrieved and spread all over the internet to discredit this pervert kike judge, maybe even generating enough pressure on him to resign.

The archive appears to have picked up changes to the website on November 29, 2004 and January 22, 2005, which may indicate it copied changes to the subdirectory at that time.

Judge declares mistrial in LA obscenity case

LOS ANGELES (AP) — A federal judge under scrutiny for posting sexually explicit material on his own Web site declared a mistrial Friday in an obscenity trial over which he was presiding.

Judge Alex Kozinski said he would ask that the case be assigned to another judge.

Kozinski is chief judge of the 9th U.S. Circuit Court of Appeals but was serving as a trial judge in a federal obscenity prosecution of a man who distributed videos showing bestiality and extreme fetishes.

"In light of the public controversy surrounding my involvement in this case, I have concluded that there is a manifest necessity to declare a mistrial," Kozinski wrote in his order.

The material Kozinski had on his Web site included photos of naked women on all fours painted to look like cows and of a man cavorting with a sexually aroused farm animal, according to the Los Angeles Times, which first reported about the images in a Wednesday story. The extreme pornography at the center of the trial depicted extreme fetishes, including bestiality, violence against women and sexual activity involving feces and urine.

The postings on the judge's Web site came to light earlier this week when opening statements were under way. The trial was suspended Wednesday after jurors had already watched some of the videos.

Kozinski on Thursday asked an ethics panel of the 9th Circuit to investigate his own conduct and pledged to cooperate fully. He also asked the circuit's judicial council to ask Supreme Court Chief Justice John Roberts to assign the inquiry to a panel of judges outside the 9th Circuit's jurisdiction of nine western states.

Kozinski did the right thing in declaring a mistrial and removing himself, said Stephen Gillers, a New York University School of Law professor who is an expert on judicial ethics.

"Those of us who know him know that he could have tried this case fairly, but the public would have thought the court system had lost its marbles if Kozinski had stayed on the case," Gillers said.

In the obscenity case, the U.S. Department of Justice is prosecuting Ira Isaacs, 57, on four counts, including importation or transportation of obscene material for sale. He faces a maximum of 20 years in prison and forfeiture of assets if convicted.

Defense attorney Roger Jon Diamond said he was very upset about the mistrial and was considering his options.

He said it was unclear whether the case could proceed with the same jury and a new judge.

Diamond accused the Department of Justice of "intimidating Judge Kozinski into doing this." Justice Department attorneys are trying the case.

"We all have to be nervous and concerned when the executive branch can do this to anybody, including the sitting federal appeals judge," Diamond said.

Department of Justice spokeswoman Laura Sweeney in Washington, D.C., declined to comment on any aspect of the case.

Diamond said there had been meetings with the prosecutor, Justice Department lawyer Kenneth Whitted, and with Brent D. Ward, the head of the government obscenity task force, since the controversy erupted.

"I made a proposal for a stipulated mistrial, providing the retrial would not take place until early next year and that was flatly rejected by Mr. Whitted and Mr. Ward," Diamond said. "They wanted to disqualify Kozinski and go ahead immediately with the same jury and a new judge Monday morning."

Diamond said he was certain jurors knew of the controversy but he had favored allowing the trial to proceed with Kozinski presiding, rather than simply changing judges.

"If we were to come back to court with a new judge, it would send a message to the jury that Judge Kozinski did something wrong, which is not true. The jury would get the impression that something naughty had occurred, which is not the case."

Cyrus Sanai, a Beverly Hills lawyer who has had a long-running dispute with the 9th Circuit, told The Associated Press he discovered the sexual content while monitoring the judge's Web site in December. Sanai said he downloaded the files then started contacting reporters to bring attention to what he called widespread ethical problems on the 9th Circuit.

“If I get convicted and go to prison now,” Isaacs said, “I go as an artist.”
