There is specific language in the Patriot Act that talks about the point that since the vast majority of Internet traffic must traverse Nothern Virginia irrespective of source or destination, the feds have de facto authority and jurisdiction over anything related to the Internet - even if the purported crime occured outside the US against an individual or entity also outside the US. The FBI hasn't missed a beat on it, they literally believe that they have the authority now to arrest a foreign national on foreign soil and bring them back to the US if a "crime" is committed using the Internet.
The United States of America (and not the United Federation of America) was created for the express purpose of limiting federal powers and giving States the power to create and enforce laws.
That fundamental concept has been undermined by a liberal interpretation of the Interstate Commerce Clause, and more recently by so-called 10th Amendment jurisdiction claimed by the federal government.
This new concept of asserting jurisdiction over Internet traffic is a hybrid of both ICC and 10th Amendment claims (across state lines, and a network/legal area not specifically controlled by the States).
Almost all US telephone carriers have migrated to unencrypted Voice over IP trunking, which means that the majority of telephone calls in the US go over the Internet instead of private telco-owned PSNs - Congress is asking the wrong questions, the Bush Administration is performing widespread Internet surveillance, this isn't about conventional wiretaps or signals intelligence, it's about NSA attaching a gigantic vacuum cleaner to interconnectivity points on the Internet and calling said Internet traffic "international communications".
Google for CAIDA, and look at how it is put together and where the main NAPs are. CAIDA is undoubtedly one of many public networks now being used for massive domestic surveillance.
