now I tried different versions of hiew, and all were the same, so what am I doing wrong, and even with beginner CRACK-ME tuts I'm having this :s

an easy guess: is your file read-only or in use in another application?

Typically your file is running, or is open by W32dsm.
Make a copy of the file with a different name: MyFileCRK.exe (which you should always do anyway, in case you screw up) and HIEW edit the copy, while you are working on the dissasembled file.

I can only speak for me, but I think we all have had that problem when we are learning to crack for the first few times. . .
