Weed is illegal under the controlled substance act which makes it illegal federally.
Unfortunately, that make it illegal everywhere in the US.
You can apply for immunity under the CSA but only about 8 people in history have every successfully done it.

Someone from Cali said that it depends on the cop, some are lenient, some will pull you in for the fine. It's definitely no jail time though, same as it is in Canada.

It's decriminalized in California, meaning that the state police officers will often ignore if you have less than 28.3 grams (although if you have like 27 grams or something, don't expect to get away with it, it's hard to judge weight just staring at a bag). If you are arrested, it's usually just a fine, similar to a drinking ticket so it's not a very serious offense. That being said, if there are federal officers around, they will very likely arrest you. In the Constitution, it clearly states that when state laws and federal laws come into conflict, the federal law will be the one used. So if your traffick herb across state, or any other sort of actions that involves the federal law enforcement agencies, even if you're in California, you will be fucked hard.
If you have less than an ounce though, whatever you're arrested with will usually be seen as a misdemeanor.

Thanks to the INCB and other evil UN bodies that eat people for money, weed isn't legal and can't be legal anywhere on earth (even Amsterdam).
I'm sure that if the founders of the US were writing the constitution, the right to do whatever substance you want whenever you want would be included. Aren't there some states where you get a 10 year minimum sentence for possession of any quantity of marijuana?

Weed is a grey area for us in Cali. We did pass Prop 215 awhile back, making it legal for medical use. http://en.wikipedia.org/wiki/Proposition_215 The bottom line is that it is still illegal under federal guidelines, so the DEA can still get you.
Also, in places like Oakland and San Francisco it is a low priority crime, running a red light is worse. Usually no one will mess with you unless you are causing a disturbance.
There have been many medical pot clubs that have been closed down by the federal government in the Bay Area, but this was usually due to tax evasion.
Weed is a cash cow in Cali and why we don't just openly sell & tax it I do not know.

From my experience, anything under an ounce is just a ticket if you promise to appear in court and if its over an ounce they book you.
Thats just for a small possessions charge. If you are charged with intent to sell or distributing then you are fucked square in the ass.
