well what happen is we were both drunk and kinda pushed each others buttons, after a while we just couldn't take it and started fighting for a while, i got him few times really good and he got me too, he ended up being bruised more, the next day he came back to my door, i open it and he was standing there i diden't think i would see this guy again for month, with my surprise, he takes something out of his pocket, it was pepper spray, and starts spraying me with it, right after, i was blinded, he started hitting me with the metal pepper spray, and i just went defense mode, knowing if i try to fight back he would either A) destroy my apterment and the paintings i have, or B) if i called the cops on him, we both would have gotten arrested, well anyways after he left i called 911 and told him the story, i dident mention to much of the fight we had yesterday but did tell them we did fight, also hes 50150 which is legally insane, and on top of that he got kicked out of the army...

knowing him, he doesn't like the idea that hes in jail now, and is most likely trying to build a case against me, what do you think he could say, like that the fight was started by me the day before and he just came back to finish it? he drove me and my cousin and my friend back home and i sat next to him in the front seat, he dident hit me then, i told him i wont fight anymore so if he hits me go ahead,

i'm not really worried but i do want to prepare for myself, if he throws something at me, i want to be ready for it, can you guys help me out, as i know this is the smartest forum on the internet, totse... so please help me out on this and tell me what possibility could happen, and even so, would i go to jail too, or would i get probation?

we'll what he is going to try to say is that i started the fight the day before when we were drunk, and he came back to finish it, and get me in trouble like this, we were both drunk, he is also a army dropout dishonorably dish arched, and top of that, hes 50150 which is legally insane, i dont know i doubt he has any good case against me for what he did is come to my apterment and used pepper spray on my grounds, the cops dident come when we faught drunk, but they did come when he used pepper spray and beat me up with it, they took pictures... is there anything i should be worries about, i mean i did beat him up good when we were drunk, i do know tak wan doe, and blocked and counter most of his shots against me, and i did beat him up in the car too... what do you guys think, does he have any kind case against me, is there anything he can really do to get me in jail too (i doubt ill go to jail, more like probation or community service)

Wouldn't pepper spray be assault with a weapon? I'd imagine that there wouldn't be much of a sentence though, the judge would probably accuse you of wasting their time as you are acquaintances and there is no way to prove that the assault wasn't a mutual fight or whatever. You need to formally warn your 50150 friend to stay away from you before you have much chance. Perhaps you should consult with a lawyer regarding an action for damages, but I can't see it much worthwhile.

What are you afraid you will get charged with in his "case"? Crazy people are always threatening to take people to court, where the learned judge will dispense perfect justice from their point of view. This doesn't happen in real life, thank god, most judges are smart and just.

Assuming you're telling the truth, there's nothing to worry about. His army record and his sanity are completely irrelevant, unless he's going to use the insanity plea to stay out of jail.

As far as "finishing the fight" goes, I'm assuming he wasn't drunk when he came and sprayed you the next day. That's not the same fight.

The fact he came back the next day is a big factor and a very damaging one for him .I would'nt worry to much what case he is trying to raise against you,I think the law is on your side in this instance.

The fight the day before was of mutual consent, however when your friend returned the day afterwards and assaulted you with a weapon, there is a clear difference between that assault and the fight of the day before. He has nothing on you, that is if this is the full story.
