Quick story I thought I'd share. So about a month ago my friend and I were driving down the road and he had a kinfe on him. He saw this fat dude walking on the sidewalk and had the bright idea to lean out of the window with his knife and yell "I'm gonna cut your tits off!" at the guy. He yelled "I've got your license plate number!" We didn't really think anything of it so we just drove on laughing.

About 2 minutes later at a stop sign, I noticed there was a big ass pickup truck probably a few inches from the back of my car, so I look back, and what do you know, its the dude my friend yelled at. So I drove off and this guy stayed about 2 feet behind me for a few minutes. I turned onto a neighborhood street and once I did, this guy pulled up next to my car saying he called the cops, I better pull over, ect. But fuck that, I wasn't about to get in some trouble over this bullshit.

So I sped off, trying to lose the guy, but I just couldnt get away. At one point, this mother fucker sped up past me and went sideways in front of my car, so I had to swerve and go sideways as well to avoid hitting him. I pulled a u turn and he kept on following me. By this point we realized we were probably gonna get pulled over by the cops so my friend ditched the knife off this bridge.

A couple minutes later I was turning onto a different street and a cop was sitting right there, and the dude chasing me started honking his horn and pointing at my car. Immediately the cop sped off after me, so I turned onto a less busy street and stopped.

Out of fucking nowhere three cop cars fishtail around another street coming in my direction, and 2 other cops did the same from the other direction. They all got out with their guns drawn so I threw the car in park and put up my hands. This cop walked up from behind, opened my door, and grabbed me and threw me on the ground and another cop did the same with my friend.

They searched us and didnt find shit so they had us sit on the side of the road. Then they searched my car and found no knife, but they did find a bunsen burner I stole from my school and made into a bong and an empty weed sack. But they didnt find a sack with a quarter O I had hidden in the roof of the car.

Then they took us to the station and did all their bullshit proccessing and shit and told me I would probably get a reckless driving ticket, a paraphenlia ticket, aggregated assault, disorderly conduct and some other bullshit.

I ended up only having to take some classes at the rehab center. But my friend is 17 so hes gonna be charged as an adult and get disorderly conduct and aggrevated assault with a deadly weapon.

I'm fuckin glad I got off so easy.

The most your friend should be charged with is verbal harassment, not aggravated assault. You two never assaulted the man nor did you intend to.

On top of that, the only evidence they have is his word versus yours. You two must have admitted something you shouldn't have.

Frankly the man coming after you in his truck is a more seriously crime then your friend yelling an insult out of a window. Your reckless driving is perfectly explainable because you had a rational fear that the man was coming after you with the intend of inflicting bodily harm.

Let me know how this plays out because the police lied about how serious the charges were in order to scare you. They knew they couldn't pin anything on you, so they scared you in order to get you to consent to the lesser punishment of just a couple rehab classes. Compared to the alternative, it looks like they're doing you a favor. But trust me, they never give you any favors. If they could get you for aggravated assault, they would have. You only got a couple rehab classes, I bet your friend gets community service at worse. Not a felony charge.

Seems like you got off easy, but with the right lawyer (or any lawyer) you would have got off scott free. Doesn't seem worth going to court over a couple rehab classes, but the key is keeping your criminal record clean for when you seek employment.

Kids these days are so trained to be scared of cops, they forget they have a right to stay silent and a right to privacy. Could have played out a lot better, other than getting into a chase with the cops couldn't have gotten worse.

I agree with you on how my friend should only be charged with verbal harrassment. But really thats his problem and hopefully he gets a good lawyer when he goes to court.

And I also agree with you that chasing somebody all the way across town trying to run them off the road is a worse crime than threatening somebody.

And about the search, I technically never gave him consent or denied a search. They literally dragged us out of the car, set us on the curb, and tore apart my car and I didnt say a word. However, I figured they had probable cause to search my car since we threatened the guy, and since they didnt even bother to ask me to search the car.

And if they didnt have probable cause to search and since I never gave them consent, I guess I could use that in court against the officers and what they found would be invalid evidence and they couldnt use it against me, or however that would work.

But the thing is I don't even have to go to court for this. I had to meet with this lady and tell her the story, and she determined whether I would go to court or not. And she decided I would take rehab classes instead of going to court, so I dont have to worry about any charges against me. So really a good lawyer wouldn't have done me any good because it wasnt a court hearing that decided my punishment of rehab classes. But I see what you mean.

The police are allowed to search your automobile if they have reasonable suspicion that a crime has occurred or that there is illegal items in your car....

ehh...nowadays not declining to a search is the same as consenting to one.

But no, the other guy simply saying that you had a knife is not enough probably cause to search the car.

Technically one random guy claiming you have a bomb in your car is not reasonable enough for them to just go ahead and search their car. But since when do the police follow all the rules.
