It depends, if it's like one time one employee type thing then no. But awhile back there was a chain where like all the employees would constantly spit in food and put cockroaches in the drinks and shit. In that case it was a public health issue and shit got real.

Its federal law, tampering with the contents of someone's food or drink without their consent is a felony (a very serious one). Im too lazy to find the exact statute but trust me on it.

Regarding that source:

Try googling "tampering with food law", then go to link #4 (Product Tampering). It's a document on what the FDA does with food tampering cases. It is indeed a federal crime, but the possibility of them not investigating it at all is there as well as the fact that it's a prosecutable offense to lie about food tampering.

With some of the shit restaurants like McDonald's and other places like it produce, I'm not sure I could tell. As far as proving it goes, you have to have someone with lab skills positively identify it as spit, and not only that, but match it to one of the employees at the restaurant.

I'm not completely sure of the latter, since I think that food is prepared on-site, meaning any tampering would have had to be done there.
