well my friend beat up a cop, pretty much kuz the cop was being a dick. i dont know the whole story, i wassnt there. he missed his first court date and so there was a warrant out for his arrest. we live in california if that helps, also advice would be appreciated.

Hate to say this dude, "your friend" is seriously fucked. That cop is gonna get him fucked to the fullest extent of the law, I'd expect some jail time.

You don't make a cop angry (let alone assault one). You'd be amazed on how much shit a police officer can do to you while still claiming 'reasonable suspicion'.

Okay, if there's one thing you don't do, it's beat up a cop. There isn't much else you can do (except shoot a cop) that will send you straight to the slammer without the judge even blinking. Also, if you as much as touch a cop without permission, they'll armbar your ass.

my friends been locked up, no one has really heard from him since his second court date.. which he went to, do you guys think it'll be more than 10 years?

What I find more hilarious is the fact that the cop 'being a dick' is the justification for the crime. Last I checked, it's not illegal to be a dick, just mildly annoying. However, assault/battery is something your friend knew was illegal. He's probably lucky he didn't get tased or shot. It sounds like some police brutality would be justified in this instance.

As far as his sentence goes, I'm sure you could look up your local statute and see what the maximum punishment is. In Wyoming, aggravated assault is punishable of not more than ten years in prison. Not sure how things would work in the Republik of Kalifornia, though.

The larger issue is going to be proving this was just a simple assault. If he tried to use any weapons or met any qualifier for it to be considered an aggravated crime, he's gonna take a bath on this one.

okay good news, my friend won his case. turns out the cop hit him first, and he was sentenced to a few months in jail. the jail system is overloaded, so he only had to serve 10% of his sentence, which was about 10 days. he's out now hahaha.

Wait a sec. You made your first post on the 16th of August and it is now the 22nd. So, the cops found your friend, he was arrested and spent the night in jail (no way are they letting you bond out that night for assaulting a peace officer), he went through his arreignment, made his plea, went to trial, won his case, was sentenced, and then served 10 days of his "couple of months" sentence (10% of a sentence, which is a new one on me but ok). He did all this in 6 days?

They must take that speedy trial shit serious in Cali huh?

this really happened, i posted the question a few days after his court date. seriously i kinda lost faith in the system because he was released in about 10 days. we do have one of the busiest court systems and packed jails in los angeles county.

Bullshit. There is no WAY his sentence was that light, even if the jails looked like sardine cans. Assaulting an office is a FELONY: More than 1 yr in prison at a minimum, even with plea bargains, ESPECIALLY with Failure To Appear on top of it.

Several years ago, I assulted a Marion County Scherrif, in Indianapolis.[He happened to be fucking my wife, at the time, and came to personally deliver my divorce papers]. Please note that I had consumed approx. 42 cans of beer at the time.

Anyway, he managed to crawl away from me and call for back-up,before I tore off his radio.

The back-up [2 officers] came in and tore into me worswe than Rodney King. I used up the rest of my energy trying to eliminate this new threat.

Since I'm Canadian and was on a work visa, I went to jail and did't get out until the plane Landed in Toronto Intl airport, with my 2 US Marshall escorts and complete with hand and leg irons.

I spent months in Max Security Federal Prison (absolutely no time outside your cell, except to see the DR)

I'd advise against such activity.

In australia....like 6 month. Actually, i think he head butted him and the cop was in a coma for a few weeks.

Pedo's get life, murderers get a few months.
