well two friends of mine are twin brothers and have started growing and dealing marijuana. I told them if caught they will get a criminal record and may go to juvi..etc
but they claim there is no way to get in trouble.
they tell me if caught:
1)they are underage and will most likely be given a warning
2)they will claim they had no knowledge of the pot growing and it was the brother's stuff...
i told them they are retarted and both will take the fall but they keep saying how the police want charge an innocent brother of having illegal substance growing if he didnt know about it...
my question is: will this work? how would the court decide their charge?...also if caught under the age cultivating and selling an illegal substance will they get a warning as they are underage and it is their first criminal charge?

It is true that it complicates the situation for the investigating officer. However if they have evidence that both brothers knew about the pot (By recording conversations about it between them) they will both get their just punishment. How underage is underage btw? Sometimes when an underage person approaches adulthood he/she may be judged far more harshly then is normal with juvis.
I don't think it would take me longer then two extra hours of thinking and talking to solve this case if I were the investigating officer.

I agree with K.O.B. Think about it this way. Cops aren't just going to stumble over their weed. If the cops come looking for weed in their house, it'll be because they already will have evidence that there's weed there, more than likely by talking to people who know the twins and figuring out that they're dealing. Thus, the cops are going to walk into that situation knowing who the culprits are, the marijuana will just be evidence needed to prove their contentions.

And to that question: 16 is a dangerous age to still be screwing around with such things. If its your first time the judge will let you of with a warning in the form of a light sentence (juvi style) But if you are a repeater there is a chance that the judge decides you spend two years in juvi to then be sent to a "normal" prison to sit out the rest.
Which is bad for you because 18 is still very young to be in prison. Its one of those moments that you really appreciate that you are still quite a child in some things.

i told them what everyone has said and they said the only precaution they need to take is if the cops talk with people around their school or neighborhood...they also told me they talk in code...not too difficult to guess but not this SWIM shit either...

it was 5, i think it might only be 2 now.
lol it is decriminalized. meaning if you are caught with anything under 25 grams (which is alot of bud.) you get a $100 fine and they confiscate it.

Juvenile criminal records are not completely erased when you turn 18. A guy I know failed a background check*, thanks to being picked up for dealing weed at age 15. Also, "so they can afford UNI (college) in a few years time"? Have they never heard of HELP, A.K.A. HECS? Not too many people pay for uni up front in this country... Sounds like they've got a solid case of the stupids. That or they're just bullshitting to make themselves feel better.

This is correct. Nothing dissapears. If you dig deep enough shit always come up. Don't believe them if they tell you they'll just forget about it. You juvenile record is seperated from your clean record when you turn 18. This doesn't mean that they destroy it. Its just goes into a locked cabinet and noone is allowed access so to speak. However some cooperates and government agencies have access to these files just in case.
