A hypothetical question....

If a person is 18 and his girlfriend is 16, they cannot have sex (under Michigan state law). However.....assuming that her parents actually did find out about it and press charges, what is the worst sentence that could be imposed on the man?

Could the man become a registered sex offender? And, if so, for how long does this stay on his record?

Also, if a condom fails and his girl becomes pregnant, is the hospital required to report this to a law enforcement body? Or are her parents just called? This particular girl's parents will more than likely not press charges, but will the police be notified by the hospital?

There was a story on the news a few months back interviewing all these 18-25 year olds with girlfriends who were underage.

They all got done for statutory rape and are registered child sex offenders.

If she sais "ok lets fuck", then it isnt rape. Just cause she's under age doesnt mean shit(in aus it's only 16 years, so it wouldnt apply). Rule number 1, ask the parents if their cool with her sleeping at your house. If yes, then it means they wont press charges.

I don't think that's a problem in Michigan. According to a quick Google search, age of consent in MI is 16, and doesn't have some of the strange qualifications that I've read in other states (in WY, for example, age of consent is 16 years old, unless one party is over four years older than the second party, at which time age of consent becomes 18).

Usually the courts will throw out statutory rape cases with age differences of 1 year or less. That's what I've heard on the radio, anyway.

As long as you don't confess though, without physical evidence they can't convict you of anything. Theoretically, anyway.

I've had a bit more time to search, and I'm finding nothing indicating that it's illegal for a person 18 years of age or older to engage in sexual activity with another person after they have reached the age of consent. Your sex ed program evidently has mislead you.

From what I'm reading, if the 16 year old is having sex with a teacher, substitute teacher, or administrator of a school where they are a student, then the age of consent moves to 18 years of age. That might be where you're getting mislead. Insofar as two consenting parties, if both are 16 years of age or older, they can engage in sexual activity.

Directly from the Michigan Penal Code:

750.520e Criminal sexual conduct in the fourth degree;

1) A person is guilty of criminal sexual conduct in the fourth degree if he or she engages in sexual "contact" with another person and if any of the following circumstances exist:
(a) That other person is at least 13 years of age but less than 16 years of age, and the actor is 5 or more years older than that other person.
(f) That other person is at least 16 years of age but less than 18 years of age and a student at a public or nonpublic school, and the actor is a teacher, substitute teacher, or administrator of that public or nonpublic school. This subdivision does not apply if the other person is emancipated or if both persons are lawfully married to each other at the time of the alleged violation.
(2) Criminal sexual conduct in the fourth degree is a misdemeanor punishable by imprisonment for not more than 2 years or a fine of not more than $500.00, or both.

There was a case on the news about a year ago where a 17 year old was sentenced to 10 years in prison because he had oral sex with a 15 year old at a party.

Keep in mind that she admitted it was consensual when she did it.

I'm not sure how that's supposed to work, though. Firstly, I don't want to be the cop on that raid, and secondly, you're going to send them to prison for punishment?

Laws differ from jurisdiction to jurisdiction. He's probably in prison because he's in NC and it was his sister, not because he shagged her.
