recently i had my atv impounded because i let a friend take it out and he ended up crashing it into a parked car on the street, not causing any damage to either really. Well stashed away there was a pipe with a half a gram of weed in or so. So today I stopped by at the place that was holding it and it was 60% ripped apart missing alot of parts. Are they legally aloud to do this? And what will the charge be, possession or paraphenilia? I also have a criminal record + 2 6 month probation sentences that I completed. Im 18 now, so im guessing jail time?

This happened in NY? All you're looking at is a a ticket for the Marijuana and a ticket for the pipe.

Yes, they're allowed to rip your vehicle apart. It's been impounded by police which means it's their property until the finish the investigation. But they have to put it back together. They're not allowed to take anything unless it's deemed evidence in the investigation. About the possession and the paraphernalia, it depends on your state's law.
It actually happened in PA, I moved here from ny last year. They didnt call yet but im assuming it will be a large fine also. I dont know anyone who went to jail for weed but it happens im sure.
Ok I got the quad back today. And found out it was not at the police barracks. It was at the towing companys place who towed it. The pipe was gone so someone obviously took it but they never said anything to me? I paid my fines and its done but nothing about the green?

"Anonymously" report the towing company for possession. Say a friend of a friend of yours said he heard from a little birdie that the company had green in their possession.
Did you ask them why the fuck your quad was taken apart?

It doesn't matter. If it was impounded by the police, they can rip it apart. What part of that don't you guys understand?

That sounds like BS to me. While a vehicle is held by a PD they're responsible for it, they can't just fuck it up without due process and a good reason.

Well, if they FOUND something in the car, then they can rip it apart looking for anything else.
Thought that would be pretty obvious.
Alright, so they found swims pipe in the back. Swim got papers in the mail stating that they found it and the charges will be for posession. It is a only a misdameanor, but thats not good for the record. So say he got probation, would there be a curfew since he is 18? Also would there be anyway to fight it with a good lawer, claiming I was setup since it was out in the open for so long. Also it was ripped apart for no reason, no probable cause at all except a rolled bugler cigarette

If its in a 'common area' then they can't pin it to one person & so therefore all they can do is consficate it.
Besides, you were not anywhere near the car when it was stopped were you?

Well, in America, if it is in what you call a "common area" and no one claims it, they'll just charge all of persons in the vehicle.

ok, we covered this in the academy a few weeks ago. was there anyone arrested at the time? if so, they can do a search incident to arrest, if not, they would have to have justification to do a search after the fact. i.e. history of offender, stolen vehicle, vehicle used in a crime. what i figure is the buddy gave up info, they did a search, now you have trouble, on flip side, tow companies aren't exactly the epitome of good moral fiber. Make your own case.
