Hello this may not be in the right place, sorry no offense intended if it is.
i live in mississippi.

Ok I am currently trying to get a job and i am facing a background check i got the job if it clears but there are some questions i have on what they check for...

I have been arrested twice on felony arrests, the charges were dropped.. will this still be held against me??? my record is clean up to this point and after. i know i can have them expunged but i do not have the money to do this at this time. it has been a year for one arrest and 10 months on the other.

the other question is this, in 2004 i recieved a written citation for contributing to the delinquency of a minor with alcohol in florida. on my return home i called to see how to take care of this and they said they were sending me a plea form, that i needed to plead guilty and notarize it and send it back with 254 dollars. ok it never showed up.. i called and no where did they have my information on this citation. i wait a while and call again... still no one knows what i am talking about. so i do nothing else.. now because i am scared it might come up i call back, and they again cannot find it, but she says let me look somewhere else and she finds my case. there is no warrant she says however there is an open case in bay county court but no activity in years. will this come up on a back ground check?

i dont know who they use for such checks but i know that it takes about a week and half to get the report back.

the other arrests were a class 3 felony arrests, but are listed as declined in the system at the district attorney's office.

any help is helpful. lol

I'm pretty sure that ALL arrests/citations will show up in a background check, even if those arrests weren't prosecuted. There is probably a procedure for getting at least the unprosecuted ones removed.

If you were underage most states automatically expunge your record when you turn 18.

If they don't automatically expunge your record they still can't view it because it's an underage closed record. They would need a court order.

Most companies can't or don't check felonies that occurred in other states. If you got your felonies from a different state they will most likely not see it.

On your employment application there should of been a section asking if you have ever been arrested under felony charged and to state the reason as to why. That would of been your opportune moment to explain yourself.

If it does come up your employer doesn't have to give you the reason as to why they didn't hire you. If they do tell you that's the reason then you have a fair chance at explaining yourself especially if you have to actually pay to have it expunged from your record.

Why would crimes that you were never charged with appear on your record?
