View Full Version : What is considered a charge of child porn?
I've always been curious how it works, fair enough a 40-odd year old downloading videos of child rape and such, but what about the younger community.
For example; If the guy has just turned 18 and he look on some 16yr old girls myspace and see's a photo of her with her tits out, could he get done for CP?

Technically yes.
But let me reveal something to this community it has been crying out for so long. I knew this for quite some time but I just like seeing such threads change into a pedo-parade.
Like I said technically you can be charged. 18 = adult, 16 = child by law. However judges take modern scientific measures into account. These days, this means that if the "victim" is 15 or older and there is no more age difference between the child and the adult then 5 years, its not staturory rape. So the maximum difference is a 20 year old with 15 year old.
This line is very close guarded. 15 and 5 years difference. So a 14 yeard old with a 19 year old is indeed 5 years difference but the age of 15 is not met thus: statutory child rape. 15 year old with 21 year old = statutory child rape. 17 yeard old with 20 year old = OK. etc.
Don't push the envelope though and go lurking for jailbait, like I said these are just measures. If they think your a pedo they will charge you and the judge will prosecute.
Cheers for clearing that up ;)
I've always been curious, don't want to get caught out if I was to get with a 16yr old. Not that I would, since I'm taken lol.
Best to be sure though.

I think it's also taken in to consideration on how the CP was filmed, etc.
I think most law enforcement agencies and Judge/Juries tend to stay away from cases where the girl was just being stupid.
I.E. a stickam video where a 15 year old strips for the 25 other people in the chat room.
That's a girl being stupid and learning her lesson.
On the other hand, if it's coaxed child abuse (I.E. rape or convincing a 9 year old to take cloths off for the camera because he clothes are dangerous) then you will be facing some serious criminal accusations.
In short:
If the girl enjoys it, you should be able to enjoy it with relative security (I use the term "relative" very loosely because if someone wants to prosecute, then they will).

Don't believe what the above poster said. Judges just love to hang a child molester and its a hype for law enforcement to go online and hunt for pedo's. Don't do that. The example I gave are about two individuals having a relationship!

I read an article a couple of days ago about a 13 year old being charged for having childporn because some older girl texted him naked pictures of herself, so now HE is getting in trouble for taking advantage of her or something.

Don't be so quick to expect rationality from the justice system.

Accused is something else then convicted comrade. That bitch made and distributed those pictures by herself. Noone forced her, noone helped in the realisation. Accepting pictures of her however is illegal. What this article fails to report is how long the boy had the picture on his phone and what he did with it.
