View Full Version : Can judge put me in jail with no hearing?

Well in June I went to jail for 2 or 3 days while awaiting sentencing for a pretty serious assault charge. I was looking at a 2nd degree felony but got it dropped to a misdemeanor assault with some plea bargaining. Well the judge put me on 6 months of probation and I also wasn't aloud to go to the school I was planning on starting because it's halfway across the country.

So about a month ago I really fucked up and got a prohibition (underage drinking) charge. That was on a saturday and that following monday I had a meeting with my PO, but I kinda didnt mention to him that I got arrested that weekend. So that Tuesday I went to court (different judge though) and my PO fond out and i got yelled at and the judge found out I lied and all that shit. So I got put on house arrest.

So my question is...... My PO told me the (original) judge wants to meet with me and talk to me about the whole situation because im on his probation, and he told me that the judge can still put me in jail if he wants to. But can he really just do that? Just say "put him in jail" and have it done? Especially after already serving half of my house arrest sentence?

You violated the terms of your probation; that alone is enough to jail you (how long, I don't know). Because you violated the terms of your plea bargain, you may be subject to resentencing under the real punishments for your crime, not the slap on the wrist you got for being young/a first offender/for pleading down, etc.

You're an idiot, by the way. You should have just drank at home.

Because you violated the terms of your pleas bargain, you may be subject to resentencing under the real punishments for your crime, not the slap on the wrist you got for being young/a first offender/for pleading down, etc.

You're saying I have a mouth? You obviously didn't read the post I was replying to. I started this thread so I could get another perspective and maybe some answers not to be criticized. I know what I did was wrong, but I didn't start this thread to hear other people tell me that.
