I want to get peoples thoughts on this, the story starts a few years ago maybe 5 or 6 and I'll just call him bob. Ok, bobs marriage is falling apart (divorce not far away) his wife is cheating on him, he thinks with a cop, and hes out of work. One day hes drinking and his wife calls the police saying hes drunk with guns and threatening to kill people, SWAT comes, he sobers up and comes out, hes arrested and everything. Then he got put in the mental hospital ( i think his wife claimed he was crazy) he was there around a month before he got out (I think he threatened calling a lawyer). Anyway he then gets screwed by heath and welfare for something, eventually moves out of state and starts a new life. recently he came back to clear some things up (i don't know what) and got around to going to the mental hospital and asking for his records and get this..... there are NO records of bob ever there. then he goes to police asks them whats going on and asks for his police record at the same time, and those don't exist either.
So basically he was falsely imprisoned, no records of it or the arrest EXCEPT his release papers from the hospital and newspaper clippings about the incident. I don't know all the details, my dad knows most of them though and i think hes planning on calling this attorney he knows and seeing what he thinks. but i want to know what you guys think. to put it bluntly, can he sue the hell out of the state for false imprisonment? he was and is not crazy.
