Basically I have discovered that my neighbor has been stealing my wireless internet. He stolen lots of my bandwidth and has slowed my connection for a long time.

I have already spoken to the police but they are pretty busy (I live in New York), so I think I may have to sue.

After I told my neighbor I'd sue him, he laughed and then made his hands into fists and kind of jerked his body in a very threatening manner. I am now considering getting this man for intimidation as well.

I am wondering if there are any educated people on here that would be able to give me some advice?

Out of curiosity, was your internet encrypted?

Well I guess the guy was smart, this still does not spare him from punishment. He stole from me and I deserve at least some repayment or some (legal)revenge.

And can anyone help me with the intimidation case? I am thinking perhaps I will hide a camera in my hallway and see if he does something like that again.

If you're not sure if it's encrypted, it likely isn't/wasn't. At least set up encryption. The policy will not care over stolen wi-fi on an unencrypted connection.

As for intimidation, it's your word versus his.

If it wasn't encrypted then your case isn't very strong.

If you did have WPA encryption or any other type of encryption, meaning he needed to enter a password before he could log on, then he's broken several other laws as well.

Of course subjects like this are almost always judged case by case given there is still a very large lack in "cyber-laws", especially pertaining to Invasion of Privacy, etc. but I think you could swing it.

Sue him and/or press charges for Invasion of Privacy, 'Hacking' you with the claim that he could steal any information off of your network, and Theft of Bandwidth. I know the several websites have sued and several people have been prosecuted for Theft of Bandwidth when it comes to website hosting. Whether it was DDOS attacking which lagged out website servers or Hotlinking from other websites. You may also be able to get him on Trespassing.

It would really help to have someone who was tech savvy with you if/when you speak to a legal aid or another policing authority.

How did you find out he was stealing your wifi? If he's on your network the path of information goes both ways... meaning you have access to his PC if he's logged on your server.

Think about it.

One way you can use to get the leeches off is to restrict the LAN IP range on your router to just the devices that connect to your router. In my case I only have two IP addresses open, one for my pc and the other to my wireless printer. Even if someone is able to crack my encryption they won't be able to use my network because there are no spare IPs assigned to my LAN for extra connections.

You sound so dumb I'm thinking you are a troll. Why the fuck would you sue somebody for stealing a little bandwidth when it could easily be avoided with probably 30 minutes of research. I hope you take this guy to court, lose (you will lose), and get left with the court costs. I also hope he laughs in your face and starts seeding torrents like its going out of style. If I was in your position, and this guy was really a problem, and I was too fucking lazy to implement some security or stop using wireless, I would see what the fuck he was using it for, gather usernames and passwords, and then fuck his shit up.
