I was suspended from my job without pay last week. They said that I violated a conflict of interest in HR. I do part ordering for an Indian Casino. I did some work on my own time for a company. I built them 4 network video servers. I never signed an employment contract or filled out tax paper work. I ended up not even getting paid for my work! Is this right? The casino is trying to get me to sign a paper to resign from my position or I'll be terminated from my position pending a trial on 12-30-08. If I sign their paper to quit my job is this the same as giving them my 2 weeks notice and receive another check? Or should I let them fire me and accept unemployment. How does unemployment work? Do you receive a percent of you pay? Thanks for any help!

You can only collect Unemployment if you loose your job "From no fault that was your own". Meaning if you're fired or resign then you can't collect.

I say you fight it. It's bullshit because you're not a real employee of the rival company. Just say you were helping a friend and that it was your own personal business then threaten sue them for invasion of privacy, etc.

I am just curious, did you sign anything on employment that said you could not work for another while employed with the casino? Do the indian casinos even pay in unemployment?
