View Full Version : Reguarding Getting Pulled Over
Just curious. Say that you were pulled over and you told the cop he couldent look in your car using your rights. If he said forced his way into your car some way because he had a made up suspicion and found something, would you still get into trouble for it?

Well like for example, let's say you have a kilo of uncut Colombian cocaine in your trunk. If you respectfully decline the officer's request to search your vehicle, but the officer just forces his way into your vehicle, takes your keys then opens the trunk to examine what was inside, this evidence wouldn't be admissible in virtually any court in the USA, at least, because it was unlawly obtained evidence; e.g. "tainted evidence," if you want specifics, I think

There is no "probably cause" a police officer can make up to open a locked trunk/case short of hearing someone yelling for help.
If you deny them the search the only thing they can do is call for a Police Dog to drive out to your location and sniff the car, if the dog picks something up then the cop has probably cause.
Other then that the poster above me is correct. Anything the police officer finds beyond violating your rights is not admissible in court and the cop will look like a fucking idiot when a cocaine dealer walks away because of a technicality and his idiot mistakes.
Technically you shouldn't get into trouble, but the cop would just lie if he were to do that in the first place and it would be your word against his unless you were recording it all or something. So you'd be screwed anyways.
