Law Enforcement CALEA Proceeding Filings

The U.S. Department of Justice and the Federal Bureau of Investigation have filed comments on behalf of all federal, state, and local law enforcement agencies in the FCC CALEA proceeding CC Docket No. 97-213. Law enforcement position related filings with the FCC are provided below.

January 19, 2006
An Opposition to the United States Telecom Association's Petition for Reconsideration of the FCC's CALEA First Report and Order (filed January 19, 2006). The United States Telecom Association's Petition for Reconsideration of the FCC's CALEA First Report and Order (filed on November 14, 2005) asked the FCC to (1) reconsider its decision to start the 18-month CALEA compliance clock on November 14, 2005, and instead start that clock on the effective date of its forthcoming order on CALEA capability requirements for broadband access and VoIP services, and (2) clarify and delineate the specific broadband access services that qualify as “newly covered services” under the CALEA First Report and Order.

December 2, 2005
An Opposition to the Center for Democracy and Technology et al.'s Request for a Stay of the FCC's CALEA First Report and Order (filed December 2, 2005). Center for Democracy and Technology et al.'s Request for Stay was filed on November 23, 2005.

August 18, 2004
The U.S. Department of Justice filed a Statement of Non-Support with the FCC opposing the February 4, 2004 petition of ALLTEL Communications, Inc. ("ALLTEL") to extend the CALEA compliance deadline to January 30, 2006, for its packet-mode communications. Specifically, DOJ opposes the granting of any further extensions of the CALEA packet-mode compliance deadline for ALLTEL's "Touch2Talk" push-to-talk service.
July 12, 2004
The U.S. Department of Justice filed a Statement of Non-Support with the FCC opposing AT&T Wireless's ("AWS") petition for an extension of the January 30, 2004, CALEA compliance deadline for AWS's push-to-talk service. AWS filed its request for extension with the FCC on April 9, 2004.
June 21, 2004
The U.S. Department of Justice filed a Statement of Non-Support with the FCC opposing Sprint Corporation's petition for an extension of the January 30, 2004, CALEA compliance deadline for its push-to-talk service ("PTT"). Sprint filed its request for extension with the FCC on January 30, 2004. Sprint deployed its PTT service in November 2003 without a CALEA surveillance solution in place and requested until January 30, 2006, to deploy a CALEA solution.
February 19, 2004
The U.S. Department of Justice filed a Statement of Non-Support with the FCC opposing Verizon Wireless' amended petition for extension of the packet-mode communications deadline under CALEA section 107(c). Law enforcement opposes the grant of any further extensions of the CALEA packet mode compliance deadline for Verizon's push-to-talk service.
